Actors Room Byron Bay Pty Ltd - Terms and Conditions

INTRODUCTION

These Terms and Conditions apply to your access to and use of services, online content, and materials provided by Actors Room Byron Bay Pty Ltd (ABN 17 674 509 187). Use of our services or digital platforms signifies your agreement with these terms. If you do not accept them, please do not proceed to use the services or website. These conditions are designed to protect the integrity of Actors Room Byron Bay Pty Ltd and the students who attend our classes.

MASTERCLASSES

1. All training, coaching, headshot sessions and space hire services are offered by Actors Room Byron Bay Pty Ltd.

FEES

2. Fees for term classes must be paid in full at least 7 days before the course begins.

3. Workshops and intensives require a deposit stipulated on the course page to confirm your place, with full payment due no later than 7 days prior unless otherwise advised.

4. Private coaching must be paid for in full before your session is confirmed.

5. Deposits for classes, workshops, and intensives are non-refundable under all circumstances.

6. Payment Plans are entirely at the discretion of Actors Room Byron Bay,  by entering into a payment plan with Actors Room Byron Bay Pty Ltd, as confirmed via email or text message communication and upon payment of the initial deposit, you agree to complete all scheduled payments in full and by the due dates provided. Once the payment plan is accepted and commenced, it is binding and must be adhered to in its entirety. Failure to complete the agreed payments may result in suspension from classes, cancellation of your place without refund, and potential debt recovery action.

PAYMENTS

6. Only fully paid participants may take part in services offered.

7. Payments must be made by the due date in Australian dollars via EFT, EFTPOS, or credit card (Visa or Mastercard only).

8. Failure to pay in full before the class or session begins will result in cancellation without a refund.

CANCELLATIONS

9. Refunds are not available for deposits or payments for any workshop, intensive, class or service.

10. Cancellations made more than 7 days in advance will incur a 30% fee, with the remainder balance payment of service that has been paid available as credit for 3 months (subject to availability).

11. Cancellations made within 7 days incur a 50% fee, with the balance that has been paid credited for 3 months.

12. Cancellations within 48 hours forfeit the entire amount paid.

13. Private coaching sessions will begin and end at the scheduled times regardless of lateness. Please advise if running late.

14. Tickets for Industry Talks and similar events are strictly non-refundable.

15. Refunds are only offered in extreme and exceptional circumstances at our discretion and do not include illness or family illness (including COVID-19), non-attendance, or change of mind.

15(a) A case where a refund would be issued is if a course / masterclass/ service is completely cancelled.

TRANSFERS

17. No transfers or make-up sessions are available for cancellations made within 48 hours.

18. If cancelling more than 7 days before a workshop or term class, you may be offered a credit (less 30%) toward a future class, subject to space and at our discretion.

19. If cancelling within 7 days, a 50% credit may be issued under the same conditions at our discretion.

20. Cancellations within 48 hours of start time result in full forfeiture.

21. Tickets to events and industry talks are non-transferable.

MEMBERSHIPS

22. Memberships must be paid on time in Australian dollars via approved payment methods.

23. Missed payments will result in removal from the database and loss of member benefits.

24. All content in the Actors Room Byron Bay database is owned by the company and must not be copied, distributed, or used for commercial purposes without written consent.

PERSONAL INFORMATION

25. Personal information provided by students may be shared with government bodies if required by law.

TERMINATION

26. Actors Room Byron Bay Pty Ltd reserves the right to:

i. Decline any application or enrolment in line with legal allowances.

ii. Modify course details or structure at any time.

iii. Cancel or terminate services at its discretion.

COURSE INFORMATION

27. Course fees, schedules, and details are subject to change without notice.

28. While all efforts are made to provide accurate information, Actors Room Byron Bay does not guarantee the completeness or correctness of any course information provided. Students should conduct their own due diligence.

PERSONAL INJURY

29. We are not responsible for injury, loss, or damage arising from participation in classes or use of our premises.

30. Participation is at the student’s own risk. By enrolling, you agree to release Actors Room Byron Bay, its staff, and affiliates from all liability.

CHANGE OF CONTACT DETAILS

31. Students must notify Actors Room Byron Bay in writing of any changes to their contact information.

STUDENT AGREEMENT

32. An application form must be submitted prior to the course start date and constitutes agreement to our terms and conditions.

33. Payment of any course fees constitutes agreement to these Terms and Conditions.

GOVERNING LAW

34. These Terms are governed by the laws of New South Wales. By agreeing to them, you submit to the jurisdiction of the courts of New South Wales.

COPYRIGHT

35. All content on our website and learning platforms is protected under Australian copyright law. You may not:

i. Copy, reproduce, or distribute any material without written permission.

ii. Reverse engineer or alter any content.

iii. Use any material for commercial purposes without authorisation.

36. Downloadable software is subject to individual licensing terms.

37. Brand names and logos remain the property of their respective owners.

38. No licence is granted for intellectual property rights through use of our website.

LINKS AND THIRD-PARTY MATERIAL

39. We are not responsible for content found on third-party websites linked from our site.

40. These links are for convenience only, and users should take precautions against potential security risks.

41. We are not liable for comments or material posted by third parties on our platform.

42. You agree to indemnify Actors Room Byron Bay against any liability arising from your use of third-party content.

LIMITATION OF USE

43. We may update these Terms at any time. Updated versions will be posted on our website. Continued use indicates your agreement to the new Terms.

44. If requested, you must stop using the site and destroy any content obtained through it, and confirm compliance in writing within five business days.
